Yes, participants can unsubscribe from the Plexus Pivotal emails. However, if they opt out and decide they want to continue to receive them, the email journey cannot recognize how far into their program they are, and they would receive the emails starting over from Day 1. Opting out of the Plexus Pivotal emails will not opt participants out of other emails they receive from Plexus. |
Resending | Will we be able to resend emails if necessary? | Contact Plexus Customer Service, and they will be able to resend an email if needed. |
Facebook Link | Will the emails being sent out with the link to the Facebook group be able to go to anyone who is not registered if they forward it to friends and family? | Yes, we cannot control whether the email can be forwarded, so people not registered for Pivotal would have access to the Facebook group join link. However, we will be monitoring the requests and since it is a private group, we will not approve those who are not registered for the program. |
After 12 Weeks | Once a participant has completed their 12-week program, do they need to re-register if they want to keep going? | Participants will need to re-register for the program at the end of each 12-week program should they choose to continue. For example, the program runs for 12 weeks, they would be able to register for a new program on the following day. |

Pause & Restart | If a participant stops doing the program in the middle and opts out of emails, but down the road (still within their 12 weeks) decides they would like to start again, can they? | They would not ‘restart’ the program. We want participants to understand this program is designed to be lifestyle content to help them in their daily lives. If they stop for a week or two but want to still do the program, they would not ‘start over’. We would get the participant placed back into the email journey where they would have left off and keep going from there. They would still have access to the time they essentially ‘missed’, so they can still access that and keep going. Once their 12 weeks are over, they can still sign up for the next program. |
Accidental unsubscribe | If a participant unsubscribes to the email journey by accident, can this be fixed? | Contact Plexus Customer Service We are currently working to find out if there is a more automated way of doing this, versus the process being so manual. |

Pivotal Program Content

New content will be available to participants every 7 days, per the individual’s Pivotal registration date. Movements | What can I expect from the Movements? | There will be a total of 3 movements per week that include 3-5 different exercises, all designed to be 25 minutes or less. Each one has an instructional video, a description of the exercise and the number of sets and reps recommended. |
Medical | Do I need to check with my doctor before starting the exercise program? | It is always recommended to check with a physician before starting a new diet or workout regimen, and there will be disclaimers on all workout videos. |

PLEASE READ THESE TERMS CAREFULLY. BY PARTICIPATING IN THE PLEXUS PIVOTAL PROGRAM AUSTRALIA, YOU AGREE TO BE BOUND BY THESE TERMS, CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE. NOTE THAT SECTION 4 CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH, IF APPLICABLE TO YOU, AFFECTS YOUR LEGAL RIGHTS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE PLEXUS PIVOTAL PROGRAM.
These Plexus Pivotal Program Australia Terms (“Australia Terms”) apply to your access to and participation in the Plexus Pivotal Program Australia (“Pivotal Program Australia”), which is operated by Plexus Worldwide, LLC, Plexus Australia Pty Ltd (ABN 35 627 543 837) or its affiliates,
(collectively, “Plexus”, “our”, “us” or “we”). These Terms do not alter in any way the terms or conditions of any other agreement you (“you”, “Australia VIP Customer” or “Australia Brand Ambassador”) may have with Plexus Australia for other products and services. In addition, these Terms complement and incorporate by reference for Australia VIP Customers: the Australia VIP Customer Terms, Australia VIP Privacy Policy, Australia VIP Terms of Use and Australia VIP subscription terms. For Australia Brand Ambassadors, these Australia Terms incorporate your Australia Plexus Brand Ambassador Agreement, Australia Website Terms of Use, Australia Policies and Procedures, Australia Subscription Terms, and Australia Compensation Plan (“Australia Plexus Terms and Conditions”) that you previously agreed to upon your enrolment and any subsequent agreements.
In the event of any conflict between the Australia Plexus Terms and Conditions and these Australia Terms, the Australia Plexus Terms and Conditions apply first and then are followed by these Australia Terms.
Plexus Australia reserves the right to change, modify, and/or eliminate the Pivotal Program Australia and/or all or any portion of these Terms or any policy pertaining to the Pivotal Program Australia at any time and in its sole discretion (where it has reasonable grounds to do so), including the right to discontinue or change the content provided under the Pivotal Program Australia, merge the Pivotal Program Australia with another program or change the content of the Australia Plexus Pivotal Completion Reward (as described in Section 1. Program Description. If we make changes, we will provide reasonable notice of any change and we will post the amended Terms and update the “Effective Date” above. We may also attempt to notify you in other ways. Where the changes are material, we will provide you with reasonable notice of the amended Terms before the changes take effect (for example, by email). Your continued participation in the Pivotal Program after the amendments to the terms take effect will confirm your acceptance of the changes. If you do not agree to the amended Pivotal Terms, you must stop participating in the Plexus Pivotal Program.
1. Program and Completion Award Description
Plexus Pivotal Australia will deliver nutrition, movement and motivational content designed to support your Plexus product regimen. If you register for the program, Plexus will send you a weekly Pivotal email with a link that will connect you to new content for 12 weeks. VIP Customers and Brand Ambassadors will need to re-register for the program to continue receiving the Pivotal email at the end of each 12-week period.
Australia VIP Customers and Australia Brand Ambassadors registered for the Pivotal Program Australia are eligible to earn up to 500 Perk Credits during the 12 week program (the “ Australia Plexus Pivotal Completion Reward). Earn 200 Perk Credits when you process three (3) consecutive subscriptions of 135 PV or more OR meet the 400 PV minimum within your Pivotal Program Australia (within 12 weeks from when you register for Pivotal). Additional 100 Perk Credits can be earned every month when you process one (1) subscription of 135 PV or more OR you spend 135PV within the same month. Personal subscriptions and personal discretionary purchases count toward the 400 PV minimum. Sales from your organization cannot be used to meet the 400 PV requirement for this Program.
Plexus Australia encourages and welcomes your social media posts to show your participation in the program. You must ensure all posts are publicly available to be shared. All posts (i) must be original and the sole creation of the submitting participant, and all right, title and interest including, but not limited to, the copyright in any post, must be owned solely by you; (ii) must not have been submitted in any other program, (iii) must not have been published; (iv) must not infringe upon any third party's rights, including but not limited to, copyright, patent or trademark, or rights of privacy or publicity, or contain material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light; (v) must not violate any law, rule or regulation; (vi) must not contain any virus, bugs, or other deleterious material; and (vii) must not contain inappropriate content, for example but not limited to, profanity, defamatory statements, words or symbols widely considered offensive to individuals of any certain race, ethnicity, religious, sexual orientation or socioeconomic groups, incite violence or contain threats to any person, place, business, or group. Each participant warrants and represents that their post complies with all these conditions. Any posts that are considered non-compliant will be removed at the sole discretion of Plexus. By sharing your social media posts, you are agreeing to let Plexus repost and/or share your experience. This means that you grant Plexus an unlimited license to use your name, likeness, voice, or written materials in any future Plexus publication, advertisement, or promotion and that you will not be entitled to any remuneration of any kind for the future use of your name, likeness, voice, or written materials. You also consent to Plexus’ (or its nominee’s) use of your post in any manner which may infringe your moral rights in the post (had you not provided this consent).
2. Eligibility
The Pivotal Program is open only to verified Australia VIP and Australia Brand Ambassadors that have agreed to the Australia VIP and/or Australia Brand Ambassador Agreement, are in good standing and are currently residing in Australia. Current Plexus employees and contractors, and immediate family members of current Plexus employees and contractors, are not eligible to participate in the Pivotal Program.
3. Joining the Pivotal Program
There are no membership fees associated with the Pivotal Program Australia. To sign up for the Pivotal Program Australia, you must be a verified VIP Customer or Brand Ambassador, be in good standing and agree to these Program Terms.
For the purposes of this Program, good standing shall mean Australia VIP Customers and Australia Brand Ambassadors who have agreed to the Australia Plexus® Terms and Conditions, who are not in violation of Plexus’ Agreements and Policies and Procedures, who have their Plexus account in an active status, and are current with all renewal and subscription fees.
4. Dispute Resolution
a. If a dispute arises relating to any relationship, contractual or otherwise, between or among Plexus, its officers, employees, members, partners, Brand Ambassadors, or vendors or arising out of any products sold by Plexus, the parties agree to attempt in good faith to resolve any such dispute in an amicable and mutually satisfactory manner.
b. If such efforts are unsuccessful for any reason, either party may serve a notice of arbitration ("Notice of Arbitration") on the other party. Notice of Arbitration will be personally delivered or sent by prepaid registered mail, courier, facsimile transmission, email or by such other means of telecommunication that provides a record of sending the Notice of Arbitration and will be effective on receipt thereof by the party to whom it is addressed. The Notice of Arbitration will be dated, and, without prejudice to any right under the applicable rules permitting subsequent modifications, will specify the claims or issues which are to be arbitrated. The parties will schedule an arbitration to occur in Sydney, New South Wales, within 45 days of receipt of the Notice of Arbitration.
c. THE PARTIES SPECIFICALLY AGREE THAT IN ORDER TO PROMOTE TO THE FULLEST EXTENT REASONABLY POSSIBLE A MUTUALLY AMICABLE RESOLUTION OF THE DISPUTE IN A TIMELY, EFFICIENT AND COST- EFFECTIVE MANNER, THEY WAIVE THEIR RESPECTIVE RIGHTS TO A TRIAL BY JURY AND SHALL SETTLE THEIR DISPUTE SOLELY BY SUBMITTING THE CONTROVERSY TO BINDING ARBITRATION IN ACCORDANCE WITH THE ARBITRATION RULES OF THE AUSTRALIAN CENTRE FOR INTERNATIONAL COMMERCIAL ARBITRATION (“ACICA”) THEN IN EFFECT, EXCEPT THAT ALL PARTIES SHALL BE ENTITLED TO ALL DISCOVERY RIGHTS ALLOWED UNDER THE FEDERAL RULES OF CIVIL PROCEDURE.
d. The parties shall attempt to select a mutually agreeable arbitrator from ACICA’s Panel of Arbitrators. If the parties cannot agree on an arbitrator or an arbitrator is not selected by agreement within five (5) business days of receipt of the Notice of Arbitration and paying of the filing fees, an arbitrator shall be selected in accordance with the ACICA’s Arbitration Rules.
e. The parties agree that any arbitration proceeding will be conducted on an individual, not a class-wide, basis, and that any proceeding between the parties may not be consolidated with another proceeding between one of the parties and any other entity or person. THE PARTIES SPECIFICALLY WAIVE ANY RIGHT TO CLASS-WIDE TREATMENT OF ANY CLAIM COVERED BY THIS AGREEMENT AND DISPUTE RESOLUTION POLICY.
f. The parties further expressly agree that (i) the arbitrator shall only reach their decision by applying strict rules of law to the facts, (ii) the arbitration shall be conducted in the English language, in Sydney, New South Wales and either party may elect to participate in the arbitration telephonically, and (iii) the arbitral award shall be issued in Sydney, New South Wales.
g. The parties, ACICA, and the arbitrator shall maintain the confidentiality of the entire arbitration process and may not disclose to any other person not directly involved in the arbitration process: (i) the substance of, or basis for, the controversy, dispute, or claim; (ii) the content of any testimony or other evidence presented at an arbitration hearing or obtained through discovery in the arbitration; or (iii) the terms or amount of an arbitration award. ACICA and the arbitrator shall have the authority to make appropriate rulings to safeguard confidentiality unless the law provides to the contrary.
h. Except as provided in the following sentences, no party shall be entitled to commence or maintain any action in a court of law upon any matter in dispute until such matter shall have been submitted and determined as provided herein and then only for the enforcement of such arbitration award. Provided that, notwithstanding this Dispute Resolution Policy, either party may apply to a court of competent jurisdiction in Sydney, New South Wales to seek injunctive relief before or after the pendency of any arbitration proceeding. The institution of any action for injunctive relief shall not constitute a waiver of the right or obligation of any party to submit any claim seeking relief other than injunctive relief to arbitration. Judgment upon the award may be entered by the Federal Court of Australia or the Supreme Court of New South Wales, located in Sydney, New South Wales or application may be made to such court for the judicial acceptance of the award and order of enforcement if the arbitrator's award or decision is not complied with within 7 days of the arbitrator's decision.
i. Arbitration in accordance with the terms of this Dispute Resolution Policy shall be the sole and exclusive procedure for resolution of disputes between the parties, including any disputes that might arise after termination of these Program Terms.
j. Notwithstanding the foregoing, any revision, modification, amendment to, or termination of the Dispute Resolution contained in these Program Terms shall, which Plexus will give reasonable notice, not apply to a dispute of which Plexus has actual notice of prior to the effective date of such revision, modification, amendment or termination. The effective date of any such revision, modification, amendment or termination shall be 30 days after the revision, modification, amendment or termination is posted on Plexus’ website at www.plexusworldwide.com.
5. Miscellaneous
Plexus reserves the right to suspend or terminate your account and/or your participation in the Pivotal Program Australia if Plexus determines in its sole discretion (where it has reasonable grounds to do so) that you have violated these Program Terms, you have more than one account, or that the use of your account or your participation in the Pivotal Program is unauthorized, deceptive, fraudulent, abusive, or otherwise unlawful. Plexus may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative (where it has reasonable grounds to do so). Depending on the particular circumstances, Plexus may not provide you with notice before suspending or terminating your account and/or participation in the Pivotal Program Australia. If your participation in the Pivotal Program Australia is terminated, you will not be provided with the Plexus Pivotal Australia Completion Reward. The use of the term “include,” “includes,” or “including” in these Australia Program Terms is illustrative and not limiting. Plexus may change, modify and/or eliminate the Pivotal Program Australia and/or all or any portion of these Australia Program Terms or any policy pertaining to the Pivotal Program Australia at any time and in its sole discretion: however, where possible, Plexus will first provide you with reasonable notice before doing so.
